BELLEVUE, WA -- Notified by Lennar Corporation of its intent to sue iShow.com, Inc. over its continued promotion of NextGen branded homes www.NextGenHome.com, iShow announces that it has filed suit in federal court against Lennar for the right to continue the promotion of its NextGen branded homes.
"It's one of those David and Goliath situations," says Paul Barnett, CEO of iShow. The bigger guy thinks he can intimidate and threaten the smaller company because they have deep pockets, we are not going away and believe we will prevail in court," added Barnett.
The record will show that for several years before Lennar filed for a trademark on Next Gen, iShow had showcased many NextGen Homes at major events such as the International Builders' Show, Kitchen & Bath Show, International CES and worked with builders and developers to build licensed NextGen Homes. In 2008, iShow won an award for its NextGen Home in Seattle WA and in 2009 built a
remarkable NextGen Zero Energy home in Las Vegas that was a national showcase for how to build an innovative, low-energy home.
iShow has records showing several Lennar executives toured iShow's NextGen Homes showcased onsite at the International Builders' Show for years prior to Lennar's filing its trademark application using the "Next Gen" name. This database includes Lennar's Mr. Roos who is often quoted by the WSJ and in other media as the pioneer of Lennar's "Next Gen" Homes.
"It's unfortunate that we have this distraction after having invested so heavily in the brand, and when the name has become associated with such positive things, such as our program to donate NextGenHomes to disabled veterans when we can, as we will do once again in Phoenix later this Spring," said Barnett. community to not give in to Lennar's pressure and we won't. When I first heard of their trademark filing, I visited with Lennar and have done my best through the years to try and work this out like adults and let the facts speak for themselves without success," said Barnett.
